Probate Property – What is probate?

It can be confusing when someone passes away and there is the matter of obtaining probate. This means that if you are the next of kin and are looking to sell on the property then you must apply for probate.

Once granted this gives you the right to handle the assets of the deceased and carry out their wishes, as specified in their will and in accordance with the law.

Probate is actually the most common reason for properties lying empty and derelict. The confusion surrounding the issue and related matters means family members often put things ‘on the back burner’ to be dealt with at a later stage.

Other reasons for properties falling into dereliction include intestacy (where there is no will), family members not wishing to sell their childhood home and family members who prove non-contactable. Unfortunately another issue can be family squabbles.
